These Terms & Conditions govern your use of the diplora.com website and, in addition to the agreements you accept in the app, your use of the Selb app. The Diplora platform is provided to healthcare organisations under separate written agreements. By using the website or the Selb app, you agree to the terms that apply to that service.

What these terms cover

  • The website (diplora.com): the sections “Use of the website” and the general sections below.
  • The Selb app: the “Selb app” sections below, in addition to the end-user licence agreement and consent documents you accept inside the app. If these web terms and the in-app documents conflict, the in-app documents prevail for your participation in the care program.
  • The Diplora platform: not governed by these terms. It is provided under a written agreement with your healthcare organisation and, for clinical studies, the study information and consent documents.

Use of the website

You may use the website for lawful, informational purposes and to contact us. When using the website, you agree not to:

  • use it in any way that breaches applicable laws or regulations;
  • attempt to gain unauthorised access to the website, its servers, or any connected systems;
  • interfere with or disrupt the website's operation, security or availability;
  • submit false information or use the contact forms to distribute spam or malicious content.

Selb app: eligibility and your account

  • The Selb app is intended for adults (18+) who participate in a pharmacist-led care program that uses Selb. Enrolment runs through the participating pharmacy.
  • You need an account to use the app. Keep your login details confidential and let us know at once if you suspect unauthorised use of your account.
  • The information you provide must be accurate and belong to you. Connect only your own Fitbit account.
  • Use of the app requires that you accept the in-app consent documents. You can withdraw consent and stop using the app at any time.

Selb app: licence and acceptable use

We grant you a personal, non-exclusive, non-transferable, revocable licence to use the Selb app for your own participation in the care program. You agree not to:

  • copy, modify, distribute, sell, or lease any part of the app, or reverse-engineer it except where the law permits;
  • use the app on behalf of someone else or feed it another person's health data;
  • attempt to gain unauthorised access to our systems or other users' data, or probe, scan, or test the vulnerability of the service without our written permission;
  • use the app in any way that breaches applicable laws.

Selb app: health information — no medical advice

  • The Selb app shows you measurements from your own Fitbit for information and to support the care program. It does not provide medical advice, diagnosis, or treatment.
  • Consumer wearables such as Fitbit are not medical devices; their measurements can be incomplete or inaccurate. Do not make medical decisions based on the app alone — always consult your pharmacist, doctor, or another qualified healthcare professional.
  • The app is not an emergency service and does not monitor you in real time. If you feel unwell or think you are having a medical emergency, call your doctor or the emergency number (112 in the Netherlands) immediately.

Selb app: your Fitbit connection

  • Connecting a Fitbit is optional but required for the app's measurement features. You connect through your own Google account and control which data types you grant access to.
  • You can disconnect your Fitbit in the app at any time; we then stop collecting new data from it.
  • Your use of Fitbit devices and of Google services remains subject to Google's own terms and privacy policy. We are not responsible for the operation, accuracy, or availability of Fitbit devices or Google services.
  • How we handle the data from your Fitbit is described in our Privacy Policy (diplora.com/privacy).

Selb app: duration and termination

  • You can stop using the app at any time and request deletion of your account and data via the app's Settings screen or by emailing us (see our Privacy Policy for details).
  • We may suspend or terminate your access if you materially breach these terms or the in-app documents, if your participation in the care program ends, or if we discontinue the app; where reasonably possible we will give you advance notice.
  • Upon termination, your right to use the app ends. Handling of your data after termination is described in our Privacy Policy.

The Diplora platform

Access to and use of the Diplora platform — the platform with which healthcare organisations collect, store and analyse health measurements from wearable sensors and other devices, including the patient app and clinician applications — is governed by a separate written agreement between Diplora B.V. and the healthcare organisation involved and, for clinical studies, by the applicable study documents. The platform's automated analysis supports healthcare professionals and never replaces their judgement; the final assessment and any treatment decision always rest with the healthcare professional. Nothing on this website constitutes an offer to provide the platform or a claim of regulatory approval.

Intellectual property

All content and software of the website and the Selb app — including text, logos, graphics, images, source code, and the Diplora and Selb names — are owned by Diplora B.V. or its licensors and are protected by intellectual property laws. Except for the limited licence granted above, no rights are granted to you.

Third-party links and services

The website and app may contain links to, or depend on, third-party websites and services (such as Google). We provide these for convenience only and are not responsible for their content, products or practices. Your use of them is subject to those parties' own terms.

Availability and changes

We aim to keep the website and the Selb app available, secure and up to date, but we do not guarantee that they will be uninterrupted or error-free. We may change, suspend or discontinue any part of them, and we may release updates to the app that you need to install to keep using it.

Disclaimer

The website and the Selb app are provided “as is” and “as available”. To the fullest extent permitted by law, we make no warranties of any kind regarding their accuracy, completeness, reliability or fitness for a particular purpose. This does not limit the commitments we make in the in-app consent documents or in mandatory law.

Limitation of liability

To the fullest extent permitted by law, Diplora B.V. is not liable for indirect or consequential loss, or for loss or damage arising from your use of, or inability to use, the website or the Selb app, from reliance on their content, or from the operation of third-party devices and services (such as Fitbit devices or Google services). Nothing in these terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for intent or gross negligence, or your statutory rights as a consumer.

Governing law and jurisdiction

These terms are governed by the laws of the Netherlands. Any disputes arising from or relating to these terms, the website, or the Selb app will be submitted to the competent court in the Netherlands, unless mandatory (consumer) law provides otherwise.

Changes to these terms

We may update these Terms & Conditions from time to time. We will revise the “Last updated” date at the top of this page and, for significant changes affecting the Selb app, notify you in the app. Your continued use after changes take effect means you accept the updated terms; if you do not agree, stop using the service and — for the app — you may delete your account.
